US $ 24M Cash Settlement Completed for Licenseholders in Talisman Energy USA Class Action Lawsuit | Texas

HOUSTON, July 6, 2021 / PRNewswire / – A federal judge has signed a distribution order $ 24 million To the licensees and the attorneys who represented them in a six-year battle over illegally paid oil and gas licenses.

Judge Keith P. Ellison at the US District Court for the Southern District of Southern Texas, Houston Division, signed the definitive motion and distribution order on 2nd July.

Judge Ellison approved the settlement during a fairness hearing in May and confirmed a 100 percent payout to class members and $ 9 million in legal fees. The hearing was the final step in a settlement proceeding with Repsol Oil and Gas United States, LLC (formerly Talisman Energy United States) on allegations that the company improperly assigned the production and owned the wells operating in the Eagle Ford Shale Basin in South texas.

“We’re one step closer to getting things back on track for over 2,700 individual licensees who have been systematically underpaid for over three years,” said Provost Umphrey attorney Bryan Blevins. “It was a long fight, but one that had to be fought.”

Along with Mr. Blevins, Provost Umphrey attorney Michael Hamilton represents plaintiffs Rayanne Regmund Chesser, Gloria Janssen and others in suit that includes licensees Texas and across the country. According to the lawsuit, the company has failed to comply with the terms of their leases of January 1, 2013, to June 1, 2016. In addition, the company changed production volumes by up to 30 percent and reportedly paid royalties based on estimated sales instead of the amount of oil or gas actually sold.

Talisman entered the Texas Oil and gas market in a joint venture with Statoil (now Equinor) in 2010. In July 2013, a revised agreement split well operations between the two companies. License holders immediately noticed a significant difference in the reported production volumes of Talisman compared to Statoil.

Repsol oil and gas United States, LLC is a subsidiary of Repsol, SA, an energy and petrochemical company based in Madrid, Spain. Repsol acquires Talisman Energy United States in 2015.

The case is Rayanne Regmund Chesser, et al. v. Talisman energy United States INC. Class Action No. 4: 16-cv-02960 in the US District Court for the Southern District of Southern Texas.
